INTRODUCTION
The use of the service is reserved for consumers over 18 years of age or those who are authorized by their legal representative and whose purpose is individual and in no case commercial or professional.
The resale or rental of the products purchased on this page is strictly prohibited, as well as their commercial or professional use of any kind.
Pescaviar SL reserves the right to modify these terms and conditions of sale at any time and without prior notice. The client is only obliged to accept the terms in force at the time of their purchase.
PURCHASE
At the time of making any purchase within our online store, users are accepting our terms and conditions described herein.
Each product is represented by several images as well as a description, true to its reality. Variations due to the characteristics or resolution of the user's or client's device are not the responsibility of Pescaviar SL.
Once the purchase is confirmed, the order will be shipped by the contracted transport agency.
Once the purchase has been made, the client can request changes to the order provided it has not been processed and is on its way; to do so, they must contact Pescaviar, indicating the provided references.
Pescaviar SL reserves the right to reject the order of any client who has previously breached the purchase conditions.
The purchase procedure will be considered complete at the moment the client confirms it, and Pescaviar SL has accepted the management in its entirety.
AVAILABILITY
Stock is limited. The products available at that time will be shown on the website.
In the event of a problem regarding the stock of an ordered product, Pescaviar SL will inform the client as soon as possible.
The purchase contract between Pescaviar SL and the client will be complete after verifying the availability of the product stock, charging the corresponding amount to the credit card, and after the client receives the order confirmation from Pescaviar SL.
PRICES AND PAYMENT METHODS
Prices include legally applicable taxes (VAT) and are displayed in Euros (EUR).
Pescaviar SL reserves the right to change the prices of the items promoted on its website at any time and without prior notice. The client must pay the price stated at the time of confirming their order.
Pescaviar SL accepts payments via Apple Pay, Google Pay, Visa, Visa Electron, MasterCard, American Express, and Maestro.
The shipment of the order will take place once Pescaviar SL has verified the banking details provided by the buyer and receives reliable authorization to charge the purchase.
This merchant undertakes not to allow any transaction that is illegal, or is considered by the credit card brands or the acquiring bank, that may or has the potential to damage the goodwill of the same or negatively influence them.
The following activities are prohibited under the card brand programs: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Buyer, Issuing Bank, Merchant, Cardholder, or cards. In addition, the following activities are also explicitly prohibited:
"Sale of alcoholic beverages to minors under 18 years of age".
SHIPPING AND DELIVERIES
Orders delivered outside the territory of the European Union may incur an extra cost due to customs or import charges. These costs will be borne by and are the responsibility of the buyer and must be settled where and how designated by the competent authority. Pescaviar SL has no responsibility whatsoever for them.
The delivery times are approximate; Pescaviar SL offers the following estimates:
- Peninsula (Spain and Portugal):
Orders placed before 11:00 am, Monday through Thursday, are delivered within 24 hours (before 1:30 pm). After that time, they will be delivered within 48 hours (before 1:30 pm), except if the purchase is made on Thursday after 11:00 am as there are no deliveries on Saturdays. In this case, the order will be delivered the following Tuesday (before 1:30 pm).
Orders placed on Fridays and during the weekend will be delivered on Tuesday of the following week (before 1:30 pm), in this way we can ensure that the cold chain is not broken.
Orders placed on national holidays or holidays of the Community/City of Madrid that fall on weekdays will be processed the following day. - Balearic Islands:
Orders placed before 11:00 am, Monday through Wednesday, are delivered within 48 hours (before 1:30 pm). After that time, they will be delivered within 72 hours (before 1:30 pm), except if the purchase is made on Wednesday after 11:00 am as there are no deliveries on Saturdays. In this case, the order will be delivered the following Wednesday (before 1:30 pm).
Orders placed from Thursday to Sunday will be delivered on Wednesday of the following week (before 1:30 pm), in this way we can ensure that the cold chain is not broken.
Orders placed on national holidays or holidays of the Community/City of Madrid that fall on weekdays will be processed the following day. - Canary Islands: No shipments are made.
- France:
Orders placed before 11:00 am, Monday through Wednesday, are delivered within 48 hours (before 1:30 pm). After that time, they will be delivered within 72 hours (before 1:30 pm), except if the purchase is made on Wednesday after 11:00 am as there are no deliveries on Saturdays. In this case, the order will be delivered the following Wednesday (before 1:30 pm).

Orders placed on national holidays or holidays of the Community/City of Madrid that fall on weekdays will be processed the following day.
Shipping costs are described during the checkout process, before the order confirmation, depending on volume and destination.
No shipments are made on Saturdays, Sundays, or holidays of the Spanish calendar and the provinces of Madrid and Murcia.
In case of loss of the product due to causes attributable to the transport company, Pescaviar SL will resend it at no cost to the buyer, once the fact has been investigated.
Upon making a purchase, the client accepts the commitment to sign the receipt document presented upon delivery of the order, in which they may include the observations they deem appropriate, always leaving a record of the state in which they receive their purchase. The client acknowledges having received the order as requested, clarifying the state in which it has been delivered.
If you wish to certify any incident, you must reflect the details of it on the delivery document and file a claim within a maximum period of 24 hours.
EXCHANGES
Shipping costs derived from an unjustified exchange are borne by the buyer.
To make an exchange, the client must contact Pescaviar SL communicating their intention to exchange the product for another within a period not exceeding 15 days from the receipt thereof.
In the event that the return generates a difference in the purchase amount in favor of Pescaviar SL, the client will pay the difference.
In the event that the return generates a difference in favor of the client, Pescaviar SL will refund said amount to the client using the same payment method used to place the order.
RETURNS
The client has the right to withdraw from the contract within 14 days from the time of receipt of the order. To exercise this right, the client must inform Pescaviar SL of their decision to cancel the purchase at the following e-mail, general@pescaviar.com and attach the following form with the required data: Model form.
If the client withdraws from the purchase contract, they will bear the cost generated by the return of the order. The client will be refunded all payments, including delivery costs, within 14 days from the moment Pescaviar SL has been informed of their decision. Said refunds will be made using the same payment method that the client used for the purchase.
In the case of returning a product belonging to a multiple order, the delivery costs will not be refunded.
Products must be returned in perfect condition and in their original packaging. No return or exchange will be accepted if the items are returned, incomplete, damaged, or opened.

The return costs and local taxes and customs expenses are the responsibility of the client. If the return costs are greater than the value of the goods to be returned, the remaining balance will be charged.
AUTHENTICITY AND INTELLECTUAL PROPERTY RIGHTS
Pescaviar SL guarantees the authenticity and high quality of its products.
It is strictly prohibited to copy or reproduce in whole or in part any content, whether textual and/or graphic, present on the Pescaviar SL website without its prior and express consent.

The client is responsible for checking the Terms and Conditions in order to determine if any changes have occurred.
The order is subject to the Terms and Conditions in force on the date and time the client places it.
The purchase contract between the client and Pescaviar SL is governed by Spanish law.
